Ballarat Driving Lessons
These Terms and Conditions apply to all driving lessons booked with Ballarat Driving Lessons.
1. Bookings and Payment
1.1 All driving lessons are booked and confirmed through Square online booking.
1.2 Full payment is required at the time of booking to secure a lesson.
1.3 Ballarat Driving Lessons accepts payment by credit/debit card and other payment methods available through Square, including Afterpay where applicable.
1.4 A reminder notification may be sent prior to each lesson; however, it remains the responsibility of the student to attend their scheduled booking.
2. Cancellations and Rescheduling
2.1 Lessons may be cancelled or rescheduled up to 24 hours before the scheduled start time.
2.2 Lessons cancelled or rescheduled with more than 24 hours notice will receive a credit that can be applied to a future lesson.
2.3 Lessons cancelled or rescheduled with less than 24 hours notice, or missed without notice, are non-refundable and the lesson fee will be forfeited.
2.4 If Ballarat Driving Lessons needs to cancel or reschedule a lesson due to circumstances beyond the instructor’s control (for example mechanical issues or licensing authority appointments), the lesson will be rescheduled or credited at no additional cost.
3. Punctuality
3.1 Students are expected to be ready at the agreed pickup location at the scheduled lesson time.
3.2 If a student is late, the lesson will still finish at the originally scheduled time and lost time may not be made up.
3.3 If the delay is due to circumstances beyond the student’s control and the instructor agrees, the instructor may attempt to make up lost time where possible.
3.4 If the instructor is delayed due to circumstances beyond their control, every effort will be made to notify the student and arrange either an adjusted lesson time or rescheduling.
4. Instructor Responsibilities
4.1 Ballarat Driving Lessons will honour all confirmed bookings.
4.2 A registered, insured, safe and roadworthy vehicle will be provided for each lesson.
4.3 All instructors:
- Hold a valid Victorian Driver Licence
- Are licensed driving instructors
- Maintain current Working With Children Check and National Police Check where required.
4.4 Instructors must be fit to teach, with 0.00% BAC and no illicit substances present.
4.5 Students must also comply with the legal requirement of 0.00% BAC and no illicit substances present while participating in lessons.
5. Driver Test Preparation
5.1 Ballarat Driving Lessons will prepare students to the best of the instructor’s ability for their driving test.
5.2 Passing the licence test cannot be guaranteed. Success depends on the student’s performance on the day of the test.
5.3 If the instructor believes a student is not yet ready to attempt their licence test, this will be discussed with the student and additional training may be recommended.
5.4 No refunds will be provided if a student does not pass their licence test.
6. Safety and Conduct
6.1 Ballarat Driving Lessons aims to provide a safe, supportive and professional learning environment.
6.2 Students must follow all instructions given by the instructor and operate the vehicle in a safe and responsible manner.
6.3 If necessary for safety reasons, the instructor may take control of the vehicle at any time, including steering or operating dual controls.
6.4 Dash cameras or in-vehicle cameras may be operating during lessons. Footage may be used for safety, insurance, training or legal purposes.
6.5 Any deliberate unsafe, illegal or reckless behaviour by the student may result in the termination of the lesson without refund.
7. Liability and Insurance
7.1 Driving involves inherent risks and other road users may act unpredictably.
7.2 Ballarat Driving Lessons takes reasonable precautions to ensure student safety but cannot guarantee that accidents will not occur.
7.3 In the event of an accident, Ballarat Driving Lessons will follow all legal and insurance procedures.
7.4 If a student causes damage to the vehicle or other property through reckless or unlawful behaviour, the insurance excess may be payable.
7.5 Where the student is not at fault, the insurance excess will not apply.
8. Acceptance of Terms
By booking a lesson with Ballarat Driving Lessons, the student (and/or legal guardian where applicable) agrees to these Terms and Conditions.
